Terms of Service

Plain-language terms for using our website and estimating services.

1. Agreement to these terms

These terms govern your use of this website and the estimating, quantity takeoff and related preconstruction services provided by Landmark Estimating, Engineering & Design Services ("LEEDS", "we", "us"). By requesting a quote, uploading documents or approving an estimate, you agree to these terms.

If you are accepting on behalf of a company, you confirm that you have authority to bind that company.

2. Services and scope

Each engagement is defined by a written quote that states the scope, estimate type, deliverables, price and delivery date. Work begins after you approve the quote.

Estimates are prepared from the drawings, specifications and information you provide. We document assumptions, allowances and exclusions with each deliverable. Scope added after approval is quoted separately.

3. Your responsibilities

Accurate estimates depend on complete information. You agree to:

  • Provide the current drawing set, specifications and addenda, and tell us when documents change.
  • Confirm you have the right to share the documents with us.
  • Review deliverables before relying on them for a bid, contract or purchase.
  • Apply your own judgment on means, methods, markups and commercial terms.

4. Fees and payment

Fees are stated in the quote as a fixed price unless agreed otherwise. Per-project work is invoiced on delivery or in advance for new clients. Monthly plans are invoiced at the start of each billing cycle and may be cancelled before the next cycle begins.

Invoices are due on the terms shown. Late balances may pause work in progress.

5. Revisions and accuracy

Revisions required by addenda, clarifications or your scope changes within the quoted scope are included until the stated bid date. If a deliverable does not match the approved scope, we correct it at no charge; if we cannot correct it, we refund the fee for that deliverable.

Accuracy ranges published on this site describe typical outcomes for the stated estimate type and document completeness. They are not a guarantee of bid results, project cost or award.

6. Use of deliverables

On full payment you receive a license to use the deliverables for the project they were prepared for. Our templates, methods, cost data and know-how remain our property.

An estimate is an opinion of probable cost. Market conditions, subcontractor availability, design changes and site conditions can cause actual costs to differ. You remain responsible for your bid and for verifying quantities and prices that are material to your decision.

7. Confidentiality

We treat your drawings, bid documents and pricing as confidential, share them only with personnel assigned to your project, and delete them on request. We will sign a reasonable non-disclosure agreement when required.

8. Limitation of liability

To the fullest extent permitted by law, our total liability arising from an engagement is limited to the fees paid for the deliverable giving rise to the claim. We are not liable for lost profits, lost bids, consequential or indirect damages.

Nothing in these terms limits liability that cannot be limited by law.

9. Website use

Website content, including budget ranges produced by the online estimator, is general information and not a project-specific estimate. You agree not to misuse the site, attempt to disrupt it or upload unlawful material.

10. Changes and governing law

We may update these terms from time to time; the date above shows the latest version. These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
